DEFINITIONS
- Separation from Employment means the decision not to offer continued employment.
- Impermissible Grounds means the use of the employee's race, religion, color, national origin, sex, sexual orientation, gender, gender identity or expression, pregnancy, age, disability, genetic information, political affiliation, veteran’s status, or other protected class in accordance with all applicable federal, state and local laws; or if the decision is otherwise a violation of state or federal law.
- SEPARATION PROCESS
At least ten (10) business days prior to the effective date, the President INVOLUNTARY DISMISSAL PROCESSEmployees serving in an at-will status may be dismissed at any time and for any reason that is not based on impermissible grounds, by the President, or the President's designee. The President or designee will notify, via hand-delivery, certified mail and/or campus email, any employee who will be separated. The College may separate employment with an employee for any reason that is not based on Impermissible Grounds.
The employee has the right to appeal the President’s or designee's decision to the Board of Trustees as outlined in Policy 3.11.3– Right of Appeal provided; however, the Board of Trustees will only hear and consider an employee’s appeal if the employee is alleging that the separation is based on Impermissible Grounds.
- RESIGNATIONS
Any employee who does not wish to be nominated for re-employment appointment should notify Employees may submit their resignation to the appropriate Vice President in writing . The College requests employees provide at least thirty (30) calendar days before the last day of work' notice of the resignation.
In cases where, in lieu of disciplinary action and dismissal, an the employee offers to unilaterally resign, the President may exercise discretion in accepting the resignation or may continue with the disciplinary and dismissal process.
